Terms of Service

These Terms of Service (“Terms”) govern your use of the Tack Health platform operated by Caris Labs (“Tack,” “we,” “our”). By creating an account or using the service, you agree to these Terms.

1. Account Terms

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must be at least 18 years old to use Tack Health.

2. Free Trial

New accounts include a 30-day free trial with full platform access for one facility. No credit card is required during the trial. At the end of the trial period, you must subscribe to a paid plan to continue using authenticated features. Public facility data remains accessible without an account.

3. Billing and Subscriptions

Paid subscriptions are billed monthly or annually as selected during checkout. All prices are in US dollars. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through the billing settings. Refunds are provided at our discretion for annual plans within the first 14 days.

4. CMS Data Disclaimer

Tack Health displays data sourced from the Centers for Medicare & Medicaid Services (CMS) Provider Data APIs. This data is provided “as is” without warranty of any kind. While we strive for accuracy, we do not guarantee that the data displayed is complete, current, or error-free. CMS data may be subject to restatement or correction.

Star rating simulations and recommendations are based on our interpretation of the CMS Five-Star Quality Rating System Technical Users’ Guide. Simulated ratings are estimates and should not be relied upon as guarantees of future CMS ratings. Always verify critical data against official CMS sources.

5. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to any part of the platform
• Scrape, crawl, or use automated means to extract data beyond normal platform usage
• Resell, sublicense, or redistribute Tack Health data or features without written permission
• Interfere with the proper functioning of the platform

6. Intellectual Property

The Tack Health platform, including its design, code, and proprietary analysis methodologies, is the property of Caris Labs. CMS data is in the public domain. Your use of Tack Health does not grant you ownership of any intellectual property rights in the platform.

7. Limitation of Liability

To the maximum extent permitted by law, Caris Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Tack Health. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

8. Termination

We may suspend or terminate your access to Tack Health at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the platform ceases immediately. You may export your data before termination by contacting support.

9. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-platform notice at least 14 days before taking effect. Continued use after changes constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the State of Kentucky, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Kentucky.
